Wayne T. Kosmerl and N. Tucker Meneely Secure Victory for Clients in Supreme Court of Maryland

On April 19, 2022, the Supreme Court of Maryland issued a 5-2 decision in Charles Riley, Jr. Revocable Trust, et al. v. Venice Beach Citizens Association, Inc., ruling in favor of Council Baradel clients, the Charles Riley, Jr. Revocable Trust and Bay Pride, LLC, and reversing the decisions of the Circuit Court for Anne Arundel County and the Appellate Court of Maryland. Wayne T. Kosmerl handled the briefing along with Tucker Meneely, who argued the case before the Supreme Court.
The Supreme Court held that the circuit court abused its discretion at trial by vacating a pretrial partial summary judgment order that awarded the Riley Trust ownership of a land parcel and then entering judgment against Riley Trust on that claim at the conclusion of trial. The Court also held that the lower appellate court erred in conditionally reinstating Venice Beach Citizens Association, Inc.’s counterclaim for a prescriptive easement, which had been dismissed before trial, because no cross-appeal had been filed.
